Buying A Timeshare

If you want to start enjoying the beach right now, the first step in ownership starts with a Buyer and a Seller.  The Seller, in this instance, could be an individual owner of a timeshare interval or the Homeowner’s Association, whose acting agent for each property is Fairchild Moss Management, LLC.  The closing process will vary in each transaction.

The Resorts or Homeowner’s Associations list timeshare resales on this website.  The management company for the resorts, Fairchild Moss Management, LLC, is a licensed Real Estate Brokerage Company in the State of Florida.  Fairchild Moss offers a convenient, efficient and timely third-party handling service to Buyers and Sellers participating in a timeshare resale transaction.  Fairchild Moss in partnership with a third-party title company such as American Title Insurance Company will oversee closings with Title Insurance.  Fairchild Moss administers a closing process without Title Insurance.

An Individual Owner can also list their timeshare information on this website for a fee of $20.00. The owner and the buyer will negotiate all terms including the purchase price, closing costs, document preparation and recording process.

The Closing Process

Closing with Title Insurance – Current Cost of $400.00 plus Purchase Price and Prior/Current/ Future Annual Assessment Fee(s)

  1. Buyer and Seller reach an agreement on purchase price and terms.
  2. The purchase contract is drawn up by Fairchild Moss staff with information supplied by the Buyer and Seller.
  3. The purchase agreement is executed by the Buyer and the Seller.  Purchase Funds are collected at this time and held in the escrow account of Fairchild Moss Management, LLC, until the closing process is completed.
  4. First American Title prepares the deed for execution by the Seller after the rescission period expires.  The executed deed goes to Volusia County for recording.  Closing information is mailed to the Buyer and the Seller.
  5. First American Title confirms the deed has been recorded and provides the Buyer with a Title Policy.  Fairchild Moss Management disburses funds to the Seller and administers notifications of sale to the appropriate parties for the Resort and Homeowner’s Associations.  The buyer will receive the original recorded deed from Fairchild Moss Management.

Closing without Title Insurance – Current Cost of $200.00 plus Purchase Price and Prior/Current/ Future Annual Assessment Fee(s)

  1. Buyer and Seller reach an agreement on purchase price and terms.
  2. The purchase contract is drawn up by Fairchild Moss staff with information supplied by the Buyer and Seller.
  3. The purchase agreement is executed by the Buyer and the Seller.  Purchase Funds are collected at this time and held in the escrow account of Fairchild Moss Management, LLC, until the closing process is completed.
  4. Fairchild Moss Management prepares and oversees execution of the deed by the Seller after the rescission period expires and then sends the deed to Volusia County for recording in the public records.  Closing information is mailed to the Buyer and the Seller.
  5. Fairchild Moss Management confirms the deed has been recorded and notifies the Buyer and Seller.  Fairchild Moss Management disburses funds to the Seller and administers notifications for the transfer of ownership to the appropriate parties for the resort and Homeowner’s Associations.  The buyer will receive the original recorded deed from Fairchild Moss Management.

Timeshare Rentals

Friends and family can enjoy a New Smyrna Beach vacation with you when they take advantage of renting an available unit at one of the properties.  The resort office can help them book a great vacation rental to coincide with your week or help you extend your stay if you decide you need a few more days of fun before you return home.

Owners may choose to offer their weeks for rent through the Resort office.  The Owner must complete a rental agreement and a W-8 BEN or W-9, whichever is appropriate, and deliver the completed forms to the Resort office.

Individual owners may, for a $20 fee, list their weeks for rent on this website.  The owner and the renter will negotiate all terms of the rental and the Owner will inform the Resort office who will be using their unit.  The Resort office will not be involved in collecting or disbursing any funds.
